Ship With Chanz (“the Company,” “we,” “us,” or “our”) is a Jamaican courier and logistics service provider offering domestic and international freight and delivery services in accordance with the laws of Jamaica.

2. SERVICE DESCRIPTION

2.1 Services Offered
Ship With Chanz provides the following services:

  • Air Freight Services – Time-sensitive international and domestic air cargo transport.

  • Sea Freight Services – Ocean freight for bulk or consolidated shipments.

  • Ground Transportation – Local courier and inland transport services.

  • Delivery Services – Last-mile delivery within designated coverage areas.

2.2 Coverage Areas
Services are available within the following locations:

  • Half Way Tree

  • Crossroads

  • Mavis Bank

  • Papine

  • Gordon Town

Additional locations may be serviced at the Company’s discretion and may attract extra charges.

3. CUSTOMER RESPONSIBILITIES

3.1 Accurate Information
Customers must provide complete and accurate shipment details, including sender and recipient information, item descriptions, declared values, and delivery instructions.

3.2 Packaging Requirements
Customers are responsible for ensuring all items are properly packed, sealed, and labeled to withstand handling and transportation. The Company shall not be liable for damage resulting from inadequate packaging.

3.3 Documentation
All required customs, shipping, and regulatory documents must be supplied. Delays caused by missing or incorrect documentation are the sole responsibility of the customer.

3.4 Prohibited Items Compliance
Customers must not ship prohibited or restricted items (see Section 7). Any undisclosed prohibited items may result in confiscation, reporting to authorities, and termination of service without refund.

4. COMPANY RESPONSIBILITIES

4.1 Standard of Care
Ship With Chanz will exercise reasonable care in handling, transporting, and delivering shipments.

4.2 Delivery Commitment
Deliveries are conducted between 7:00 AM and 6:00 PM, excluding public holidays, unless otherwise agreed.

4.3 Third-Party Carriers
The Company may use third-party carriers, airlines, shipping lines, or agents and shall not be liable for their independent acts or omissions beyond applicable legal limits.

5. PRICING AND PAYMENT TERMS

5.1 Pricing Structure
Shipping charges are calculated based on:

  • Weight (per pound)

  • Dimensional weight (whichever is greater)

  • Service type (air, sea, ground)

5.2 Additional Charges
The following fees may apply:

  • Processing fees

  • Service charges

  • Handling fees

  • Customs-related fees (if applicable)

  • Storage fees (see Section 8)

5.3 Payment Terms

  • Full payment is required upfront before shipment processing.

  • Prices are subject to change without prior notice.

  • Non-payment will result in shipment delay or cancellation.

6. LIABILITY AND INSURANCE

6.1 Limitation of Liability
Ship With Chanz’s liability is limited to the lesser of:

  • The declared value of the shipment, or

  • The maximum liability permitted under Jamaican law.

6.2 Excluded Liability
The Company is not liable for:

  • Loss or damage to prohibited or undeclared items

  • Consequential or indirect losses (including loss of profits)

  • Delays not caused by gross negligence or willful misconduct

6.3 Claims Process
Damage or loss claims must be submitted in writing within 72 hours of delivery, along with supporting evidence. Claims submitted after this period may be denied.

7. PROHIBITED AND RESTRICTED ITEMS

The following items are strictly prohibited from shipment:

  • Firearms and firearm parts

  • Ammunition

  • Explosives and fireworks

  • Weapons (including swords and similar items)

  • Illegal drugs and controlled substances

  • Motor vehicles

  • Specific agricultural products including:

    • Coconut derivatives

    • Edible oils

    • Dangerous goods and hazardous materials

    • Perishable items without prior written approval

    • Currency, precious metals, or negotiable instruments

This list aligns with Jamaican Customs Agency regulations, the Dangerous Drugs Act, Firearms Act, and other applicable laws.

8. DELIVERY TERMS AND STORAGE

8.1 Delivery Attempts
If delivery fails due to incorrect information or recipient unavailability, the customer may be charged additional delivery or handling fees.

8.2 Storage Fees

  • Packages held over 10 days will attract a storage fee of JMD $200 per day.

  • Unclaimed packages may be disposed of or auctioned in accordance with Jamaican law.

9. FORCE MAJEURE

Ship With Chanz shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:

  • Severe weather conditions

  • Customs inspections or delays

  • Government actions or regulations

  • Strikes, natural disasters, or acts of God

10. DISPUTE RESOLUTION

10.1 Complaint Process
Customers must submit complaints in writing via email within a reasonable timeframe.

10.2 Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of Jamaica.

10.3 Jurisdiction
Any disputes shall be resolved exclusively in the courts of Jamaica.

11. PRIVACY AND DATA PROTECTION

Ship With Chanz collects and processes customer information solely for service delivery purposes and complies with the Data Protection Act of Jamaica (2020). Customer information is not sold or shared with unauthorized third parties.

12. MODIFICATION OF TERMS

The Company reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on the Company’s website and take immediate effect upon publication.

13. TERMINATION OF SERVICE

Ship With Chanz reserves the right to suspend or terminate service without notice if:

  • The customer violates these Terms

  • Fraudulent or illegal activity is suspected

  • Payment obligations are not met

14. REFUND POLICY

14.1 Refund Requests
Refund requests must be submitted in writing with supporting documentation.

14.2 Eligibility
Refunds may be granted at the Company’s discretion and exclude:

  • Processing fees

  • Handling charges

  • Completed or partially completed services

14.3 Payout Method
Approved refunds will be processed using the original payment method within a reasonable timeframe.

15. ACCEPTANCE OF TERMS

By using Ship With Chanz services, the customer confirms they have read, understood, and agreed to these Terms and Conditions in full.
